Environmental groups lost their challenge to the Forest Service's plan to log areas of the Plumas National Forest in the Sierra Nevadas that were burned in the 2007 Moonlight and Wheeler fires. The Ninth Circuit ruled 2-1 in favor of the Forest Service. You can read the decision here. The environmental groups argued that the Forest Service had failed to ensure viability of the black-backed woodpecker under NFMA.
