New Lawsuit: Swanson Group MFG. v. Salazar, No. 10-cv:01843 (D. D.C., filed Oct. 29, 2010)

In this case, filed with the District Court for the District of D.C., the plaintiffs are a coaltion of timber companies and associations who challenge parts of the Northwest Forest Plan.  Specifically, the plaintiffs target teh Owl Estimation Methodology used by the Forest Service to estimate the number of northern spotted owls affected by the plan.  They claim that the adoption of this methodology, which the plaintiffs characterize as a rule, was arbitrary and capricious.  Other defendants in the action include the Bureau of Land Management and the US Fish and Wildlife Agency.
