The newly proposed planning rule, here, is already causing stir amongst environmentalists. Courthouse News Service reports here that the big corporate environmental law firms: Earthjustice, Center for Biological Diversity and Defenders of Wildlife have all come out against the proposal. They claim that it does not insure enough protections for species viability and watershed protection. They claim it will give too much discretion to the judges who hear their lawsuits. In other words, they believe they will lose more lawsuits under this proposed set of rules. This will certainly be a story to watch as Obama will be attacked from both the left and the right on the proposal.
