Minneapolis - Earlier this year the 8th Circuit Court of Appeals heard oral argument over the Sierra Club's challenge to the newly revised land management plan for the Superior National Forest. The case presents an interesting issue on whether the Sierra Club can bring a bare challenge to the plan outside of the context of an actual project. Although the panel was cold to the issue of standing, it picked apart the Sierra Club's case on the merits. To listen to the arguments click here and enter case number 09-1639.
